Privacy Policy

Last updated: 03/13/2023

Introduction

We’ve updated our Privacy Policy. These updates are intended to make our Policy easier to understand and to reflect recent developments in US privacy law (such as the enactment of the California Consumer Privacy Act (“CCPA”) and its amendment under the California Privacy Rights Act (“CPRA”)).

This policy describes the types of information GT Golf Supplies and its parent, subsidiary, and affiliate companies (collectively, “GT Golf,” “we,” or “us”) collects, as well as how it’s used, disclosed, protected, and retained through our website from which you are accessing this Policy, cloud business platforms through which we interact with you, our social media pages on third-party social media platforms, email, text, mail, and any offline business interactions you have with us (collectively, our “Services”). It also explains your privacy choices and rights, as well as how to exercise them.

Please note that this policy does not apply to information collected by third parties, including through any application or content (including advertising) that may link to or be accessible from or through the Services.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use our Services. By accessing or using the Services, you agree to this privacy policy.

Please understand that our Services are not intended for children under the age of 16, and children under the age of 16 are not permitted to use our Services. We do not knowingly collect information online from individuals under the age of 16. If we obtain actual knowledge that any information, we collect has been provided by a child under the age of 16, we will promptly delete that information. If you believe we might have any information from a child under 16, please contact us by email at privacy@ggolf.com. We do not knowingly “sell” or “share” (as those terms are defined under the CCPA and other US privacy laws) the personal information of consumers under 16 years of age.

Note that this policy may change from time to time. Your continued use of the Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

·        From third parties, for example, our business partners.

Additionally, we cannot control the actions of other users with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be used by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your devices, browsing actions, and patterns, including:

·        Details of your visits to our website, including traffic data, location data, logs, and other communication data and the resources that you access and use on the website.

·        Information about your device and internet connection. For example, we may collect information that is automatically sent to us by your computer or mobile web browser or your internet service provider. This information typically includes your device’s hardware model, browser type, IP address, operating system version, language settings, unique device identifiers, advertising identifiers, serial numbers, how your device interacts with the Services, network information, and mobile network data.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Please contact us for information on how you can opt out of behavioral tracking on this website.

The information we collect automatically may include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties, such as other customers who may send you a product, social media providers, marketing and advertising partners, and fraud prevention services.  This helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to:

·        Estimate our audience size and usage patterns.

·        Store information about your preferences, allowing us to customize our website according to your individual interests.

·        Speed up your searches.

·        Better understand you and provide you with information and offers that may be of interest to you.

·        Recognize you when you return to our website.

The technologies we use for this automatic data collection may include:

·        Cookies (or browser cookies). Cookies are files that are placed on your computer or mobile or handheld device (such as smartphones or tablets) when you visit certain pages on the internet or use certain mobile applications. They can be used to “remember” when your computer or device access our website. Cookies are stored in your browser. The cookie will help the our website, or another website, to recognize your device the next time you visit. Most cookies won’t collect information like a name or email address that directly identifies you as a person and will instead be used in efforts such as collecting more general information such as how visitors arrive at and use a Site. Cookies may, however, be used to create a profile of the visitor's activities on the Internet, and they can contain unique identifiers or any form of personal information.

Our uses of such technologies usually fall into one of the following categories:

·        Strictly Necessary Cookies. These cookies, which may be set by us or third-party providers, are necessary for the website to function, and we do not offer an option for them to be switched off. They are usually only set in response to actions made by you which amount to a request for services, such as logging in or filling in forms, or they may be set when you simply load a page. You can set your browser to block or alert you about these cookies, but some parts of the website will not then work if you block them.

·        Performance Cookies. These cookies, which may be set by us or third-party providers, allow us to count visits and traffic sources so we can measure and improve the performance of our Site. They help us to know which pages are the most and least popular and see how visitors move around the Site. If you block these cookies, we cannot use them to know when you have visited our Site and will be less able to monitor its performance.

·        Functional Cookies. These cookies enable the website to provide enhanced functionality and personalization. They may be set by us or by third-party providers whose services we have added to our pages. If you block these cookies, then some or all of these services may not function properly.

·        Targeting and Social Media Cookies. These cookies may be set through our Site by or in collaboration with our advertising and social media partners. They may be used by those companies to build a profile of your interests and show you relevant ads on other sites. They are based on uniquely identifying your browser and internet device. If you block these cookies, you will experience less targeted advertising.

A note about third-party cookies:

Some content or applications, including advertisements, on our website are served by third parties, including our third-party marketing partners, such as advertisers, ad networks and servers, content providers, application providers, and social media sites. These third parties may use cookies (alone or in conjunction with web beacons or other tracking technologies) to collect information about you when you access our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising and other targeted content. We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about advertisement or other targeted content, you should contact the responsible provider directly.

·        Web Beacons. Pages of our website and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs). In contrast to cookies, which are stored on your device, clear GIFs are embedded invisibly on web pages. We may use clear GIFs (a.k.a. web beacons, web bugs, or pixel tags), in connection with our Site and with cookies to, among other things, track the activities of Site visitors, help us manage content, compile statistics about Site usage, and engage in targeted advertising. We and our third-party service providers also use clear GIFs in HTML emails we send, to help us with things like tracking email response rates, identifying when our emails are viewed, tracking whether our emails are forwarded, and customizing email or Site content. These statistics allow us to understand the popularity of certain content or products, for example.

Sensitive Information

While GT Golf does not collect precise geolocation through our website or online services, our service providers may collect such information to find a store near you using your location data which may be considered “sensitive personal information” or “sensitive data” within the meaning of the CCPA and other US privacy laws. In most other cases, we do not ask you to provide, and we do not knowingly collect, any sensitive personal information (as defined under the CCPA and other US privacy laws) from the typical consumer as part of the Services (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background, or trade union membership). Unless we request it, we ask that you not send us, and you not disclose, any sensitive personal information on or through the Services or otherwise to us. In addition, to participate in an investigation of unlawful conduct (e.g., fraud or counterfeiting), we may collect any personal information permitted by law, which, depending on the details of a particular investigation, could include any category of sensitive personal information.

We do not “sell” or “share” sensitive personal information about Californians within the meaning of the CCPA and other US privacy laws, and do not use “sensitive personal information” for any purposes that are incompatible with the disclosed purpose for which it was collected or other than those permitted purposes authorized by US privacy law.

Disclosure of Your Information

Please note that we do not sell consumers’ personal information for money. We may disclose personal information that we collect or you provide as described in this privacy policy:

·        To our subsidiaries and affiliates.

·        To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

·        To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about the users of our Services is among the assets transferred.

·        To third parties to market their products or services to you if you have not opted out of these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them. For more information, see Choices About How We Use and Disclose Your Information.

·        To fulfill the purpose for which you provide it.

·        For any other purpose disclosed by us when you provide the information.

·        With your consent.

We may also disclose your personal information:

·        To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

·        To enforce or apply our posted Terms of Use and other agreements, including for billing and collection purposes.

·        If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of GT Golf, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

·        Opt-Out of Email Communications. If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out by clicking the “unsubscribe” link at the bottom of any GT Golf marketing email. Please allow 10 days for the change to take effect. Note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages, from which you cannot opt-out

·        Close Your GT Golf Account. If you wish to close your account at any time, please contact us by using the “Contact Us” below.

·        Manage Tracking Technologies and Advertising.

·        You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. Please consult the “Help” section of your browser for more information. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

·        We may work with third-party advertising companies that collect and use information about your online activities across sites over time, in order to deliver more relevant advertising when you are using our Services and elsewhere on the Internet. You can learn more about interest-based advertisements and certain opt-out options from members of the Network Advertising Initiative (“NAI”) on its website (www.networkadvertising.org) and from members of the Digital Advertising Alliance on its website (www.aboutads.info). We do not control these opt-out links or whether any particular company chooses to participate in these opt-out programs, and we work with some advertising companies that don’t participate in those programs. We are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by checking the relevant box located on the form on which we collect your data. You can also always opt-out by sending us an email with your request to privacy@ggolf.com.

Residents of certain states may have additional personal information rights and choices. Please see Your State Privacy Rights for more information.

Accessing and Correcting Your Information

You may also send us an email at privacy@ggolf.com to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from our Services, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other users of the Services.

Residents of certain states may have additional personal information rights and choices. Please see Your State Privacy Rights for more information.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. To exercise such rights, please send an email to privacy@ggolf.com.

If you are a resident of California, you may request the following by contacting us as detailed in the “Contact Us” section described below.

·        Access. You have the right to know and request that we disclose certain personal information we hold about you, as well as details about whether and to whom your personal information was disclosed, shared, or sold, subject to certain exceptions.

·        Deletion. You have the right to request that we and our service providers and contractors delete any of your personal information that we collected from or obtained about you, subject to certain exceptions.

·        Correction. You have the right to request that we correct any inaccurate personal information that we maintain, considering the nature of the personal information and the purposes of its processing. You can also review and change your personal information by signing into your account and visiting your account page. Please note that we may not be able to accommodate your request if we believe it would violate any law or legal requirement or cause the information to be incorrect.

·        Portability. You have the right to obtain a copy of your personal information that was previously provided in a portable and readily usable format, to the extent technically feasible, subject to certain exceptions.

·        Opt-Out. You have the right to opt-out of the “sale” or “sharing” of your personal information as defined under certain California privacy laws (and the use of your personal information for certain targeted advertising activities) as described in more detail below. To begin the opt-out process, email us at privacy@ggolf.com. Note that we do not use California personal information for “profiling” for which certain US privacy law requires a “profiling” opt-out.

You are also provided the right to not be discriminated against for exercising your rights.

Except for most opt-out requests, we cannot honor your request (such as to provide you with requested personal information) if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

The verifiable consumer request must:

·        When appropriate, provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative (e.g., name, email, mailing address).

·        Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

If you are a California resident, you may designate an agent to exercise your rights on your behalf. We reserve the right to take steps to verify the identity of the agent, and that your agent has been authorized to make a request on your behalf. Such steps may include requiring that the agent submit a copy of a qualifying power of attorney or requiring you to confirm the request with us directly. For legal and security reasons, we do not accept requests that would require us to visit an agent’s website.

California “Shine the Light” Disclosure

California Civil Code Section 1798.83 (California’s “Shine the Light” law) permits customers that are California residents and who provide personal information in obtaining products and services for personal, family, or household use to request certain information regarding our disclosure of personal information to third parties for their own direct marketing purposes. If applicable, this information would include the categories of personal information and the names and addresses of those businesses with which we shared qualifying California personal information during the immediately prior calendar year (e.g., requests made in 2023 would receive information regarding such activities in 2022). You may request this information once per calendar year. To make such a request, please contact us by email at privacy@ggolf.com.
